PROBLEM TO BE SOLVED: To execute efficient multiplex processing that corresponds to an actual generation bit rate with an easy configuration by adding bit rate information about the actual generation bit rate of an encoded bit stream which is produced by encoding input data to a prescribed area of the encoded bit stream and sending it. SOLUTION: An encoding and multiplexing device 100 adds information about an actual generation bit rate to a user data area by encoders 101A to 101N as user data and outputs it as encoded bit streams D101A to D101N to a multiplexer 102. The multiplexer 102 respectively reads user data in the user data area by a multiplex controlling part 104 as a multiplex control processing means when information from a start synchronous code of a sequence layer to the user data area is stored, calculates an actual generation bit rate based on the user data and knows the generation bit rate in a short time.
