PROBLEM TO BE SOLVED: To provide a manufacturing method of an optical element which can surely and efficiently produce an optical surface having an optical path difference imparting structure and to provide the optical element formed by the manufacturing method. SOLUTION: In the manufacturing method of the optical element by which a nano composite material comprising particulates dispersed in a plastic resin is molded to the optical element, a preliminary shaped piece having a predetermined curvature at a pressing position is molded in advance from the nano composite material, then the preliminary shaped piece is molded by heating and pressing the pressing position to produce the optical surface having the optical path difference imparting structure.
