PROBLEM TO BE SOLVED: To provide a vehicle control device capable of detecting only calling by a portable telephone, PHS or a portable communication apparatus similar to them owned by a driver himself, and capable of positively taking a measure for the telephone in driving when the calling is detected, and a telephone usage detection method in driving for detecting telephone usage in driving. SOLUTION: An image of a driver seated on a seat of a vehicle is taken by a camera 1, and the taken image is captured by an image processing unit 3. In the image processing unit 3, a face region of the driver is retrieved among the images taken by the camera 1, and a hand region of the driver near the face region detected as a result of the retrieving is retrieved. In a vehicle control unit 4, it is determined that the driver is calling when the hand region of the driver is continuously detected on the image processing unit 3 side, and an execution command of vehicle control is outputted to controllers of the vehicle.
