A data transceiving apparatus using an improved random access channel in a mobile communication system and a method thereof are provided to define the transmission format of an E-AGCH to improve an E-RACH(Enhanced Random Access Channel) transmission procedure and the related E-RACH transmission procedure. A base station determines whether a preamble which a mobile station transmits is received without the error(704). If so, an E-AICH(Enhanced-Acquisition Indicator Channel) corresponding to the preamble is generated through information included in the preamble and then is transmitted to the mobile station(706). The base station receives a power control preamble from the terminal, performs the power control for the mobile station and then receives data transmitted from the mobile station(708,710).
