An apparatus and a method for setting communications of the terminal deviating from a cell region from a mobile communications system are provided to perform efficient emergency call outside a cell area without waste of resource or additional overhead. A synchronization unit(818) estimates a downlink time section. A controller(806) selects one out of a preamble code set reserved for the establishment of communications of the terminal deviating from the cell coverage. The controller transmits the preamble code selected from the time interval which is set up so that the base station transmit preamble among the down link time interval.
