PROBLEM TO BE SOLVED: To obtain a propaganda effect that is high for an advertiser of a CM, and to also enable a viewer to select a CM to be viewed. SOLUTION: The present invention relates to a recording and reproducing device comprising a protection function with which a program can not be erased without viewing CM during reproduction of the program, wherein in an initial state of the recording and reproducing device, at least a recording region 102 recording a CM or a program containing CM is set and when the CM or the program containing CM recorded in the recording region is viewed, protection to disable the program to be erased is canceled for a recording region 104 corresponding to viewed recording capacitance to obtain empty capacitance 106 available for recording.
