An encoding apparatus, a recording medium recording an encoding program, and an encoding method are provided to monitor an encoding condition about image encoding and control an intra refresh region and an intra refresh period to be varied on the basis of the monitored encoding state, thereby improving the efficiency of encoding to prevent the deterioration of the image. An encoding apparatus(20) inserts an intra refresh region into a part of an image periodically on the basis of an intra refresh period to encode the image in encoding an input image. The encoding apparatus includes an encoding state monitoring unit(25) and a refresh region control unit(26). The encoding state monitoring unit monitors an encoding state related to image encoding. The refresh region control unit controls the intra refresh region and/or the intra refresh period to be varied on the basis of the encoding state monitored by an encoding state monitoring order.
