PROBLEM TO BE SOLVED: To provide a congestion control method whereby re-transmission data amount at the time of data loss is reduced and the disturbance of data continuity which gives influence on an application is reduced. SOLUTION: A PDU(protocol data unit) size managing part 15 referrs to a PDU size indexing table 16 in accordance with a congestion occurrence report from a low-order layer protocol 2 processing part 13 or a low-order layer protocol 1 processing part 14, obtains an optimum and max. PDU size at the time of the occurrence of a congestion whose size is smaller than that at the time of non-congestion in accordance with the low-order layer protocol from which the congestion report is given, updates a PDU size managing table 171 and also indicates PDU, size change to a transport layer protocol processing part 12. Thus, at the time of the congestion, the size of PDU given from the transport layer protocol processing part 12 to a low-order layer becomes smaller compared with the case of non-congestion.
