PROBLEM TO BE SOLVED: To provide an optical element which can be made small in size, which can efficiently control the quantity of transmitted light with a simple structure and which is suitable for a variable ND filter, apodization filter, correction filter for decrease in ambient light quantity or the like, and to provide a photographing device. SOLUTION: The optical element 101 is used to control the quantity of transmitted light of beams, and is equipped with a conductive or polar first liquid 121 and a second liquid 122 having a different transmittance from that of the first liquid 121, both having substantially equal refractive indices and not mixed with each other. These liquids are sealed in the space formed between first and second substrates while the interface between the first and second liquids forms a part of an almost spherical surface having a specified optical axis. The quantity of transmitted light of the beams passing the device is changed by controlling the output of the voltage to be applied on the first liquid to change the shape of the interface.
