PROBLEM TO BE SOLVED: To provide an image encoding device capable of normally reproducing an audio stream including an illegal frame which can not be reproduced. SOLUTION: When no illegal frame is included, an illegality detecting circuit 10 switches the input of a multiplexer 11 to an audio stream side to output an externally inputted audio stream to a system multiplexing device 8. When an illegal frame is included, the illegality detecting circuit 10 switches the input of the multiplexer 11 to the side of an audio compressing device 9 and the input of a multiplexer 12 to a soundless audio signal side while the illegal frame is externally inputted. The audio compressing device 9 compresses a soundless audio signal and outputs a soundless frame, and the audio stream having the illegal frame converted into the soundless frame is outputted to the system multiplexing device 8.
