PROBLEM TO BE SOLVED: To improve the problem of defects such as a scratch onto a surface layer and enhance yields and mass-productivity, in a polishing process of a surface of an optical recording medium. SOLUTION: In the optical recording medium M used at a distance of <=200 nm to an optical system performing at least one of recording and reproducing of information by photoirradiation and having at least a recording layer, the surface layer 6 having high hardness and made of a nitrogen compound or a carbon compound having light transmissivity to irradiating light is formed on the surface to which the photoirradiation is performed to effectively avoid the generation of the defects such as the scratch.
