<p><P>PROBLEM TO BE SOLVED: To provide an apparatus and method for enabling optimal rate control to be performed in data transmission/reception between a server and a client. <P>SOLUTION: A maximum throughput is calculated on the basis of the measurement value of a period of time from continuous data transmission start to acknowledgement (ack) reception, thereby controlling a transmission bit rate. Namely, rate control is performed with a maximum allowable throughput, as an upper limit, equivalent to a maximum throughput calculated on the basis of a data transmission/reception period except for a data transmission/reception non-execution period during which there is no contribution to data transmission/reception, or equivalent to a maximum throughput calculated on the basis of the reception interval of continuous transmission packets measured at the client.
