A face validity verifying device for determining the banking machine working and a method thereof are provided to determine the operation of an ATM(Automated Teller Machine) after verifying the validity of the face recognition. A screen change sensing member(200) senses the change of a screen. A background removing processing member(300) removes and processes the circumference background color from the sensed outsider's screen. A color classification member(400) classifies and checks the main distribution color from the photographing screen of the outsider. A face position chasing member(500) chases the position of the outsider's face. An effectiveness determining member(600) determines the effectiveness of the outsider's face.
