PROBLEM TO BE SOLVED: To easily produce an electrophotographic photoreceptor having high mechanical strength while maintaining superior solvent cracking resistance and also having satisfactory resistance to electricity due to direct electrification by incorporating a polymer having specified constituent units into the surface layer of an electrophotographic photoreceptor. SOLUTION: This electrophotographic photoreceptor contains a polymer having constituent units represented by the formula in the surface layer 12. In the formula, X1 is -CR17 R18 - (each of R17 and R18 is H or 1-5C alkyl), optionally substd. 2-10Cα,ω-alkylene, etc., each of R1 -R4 is -CH2 -CH=CH2 , H, halogen, etc., at least one of R1 -R4 is allyl, each of R5 -R8 is -CH2 -CH=CH2 , H, halogen, etc., at least one of R5 -R8 is allyl, each of R9 -R16 is H, halogen, etc., and each of (l) and (m) is 1 or 2.
