A data transceiving device of a wireless short-range network and a method thereof are provided to enable a transmission apparatus to receive congestion generation information from a receiving apparatus to stop transmitting data to the receiving apparatus and to send data to another receiving apparatus, thereby lowering a PER(Packet Error Rate). If data is received through a PCA(Prioritized Contention Access) section, a congestion decider(130) decides whether congestion occurs in a receiving buffer(120) for storing the received data. If so, a congestion information transmitter(140) transmits congestion generation information to the PCA section or a BP(Beacon Period) section by using an MAC(Medium Access Control) frame or a self beacon frame.
