A polynucleotide comprising ubiquitous chromatin opening elements(UCOE), not derived from LCR(locus control region), is provided to open chromatin or maintain open state of chromatin and promote reproducible expression of genes operatively linked in at least two different tissue type cells. A polynucleotide comprises ubiquitous chromatin opening elements including (a) an methylation free CpG-island having the nucleotide sequence with 300 or more base pairs, (b) an expressive gene operatively linked to the CpG-island but not linked naturally, and (c) a promoter operatively linked to the gene but not linked naturally, wherein the expressive gene is reproducibly transcribed in at least two different tissues, the CpG-island is TATA-binding protein gene CpG-island or the CpG-island except human hn RNP A2 gene CpG-island.
