A broadband wireless access system and a radio resource waste prevention method of the system are provided to enable another subscriber terminal which conducts the same service as a subscriber terminal to transceive data prior to the subscriber terminal which wastes bandwidths, thereby solving a problem that another subscriber terminal has a little change of being allocated with bandwidths from a base station. If bandwidths included in a bandwidth allocation request message sent from a subscriber terminal are smaller than allocable bandwidths, a time slot allocator(23) allocates time slots to include the slots in a bandwidth allocation message, and sends the message to the subscriber terminal. If a bandwidth allocation reception response message is received from the subscriber terminal, a timer setup unit(24) sets data reception time information for normal reception of data. A preference processor(25) increases/decreases the number of unused times of bandwidths, depending on whether data is received from the subscriber terminal within the data reception time. An uplink scheduler(26) controls priority for data transceiving with another subscriber terminal which conducts the same service as the subscriber terminal, depending on whether the number of the unused times of the bandwidths corresponds to the set bandwidth frequency.
