A packet scheduling apparatus and a method thereof are provided to adaptively control an FER(Frame Error Rate) threshold value for determining an MCS level for data transmission according to QoS required for a service which a mobile terminal will receive, thereby maintaining fairness of a data transfer rate in accordance with each service type and/or fairness of data transfer rates in accordance with mobile terminals. A packet scheduling method for transmitting a packet to a terminal receiving a specific service when two or more types of services are provided to plural terminals, comprises the following steps of: respectively determining MCS(Modulation and Coding Scheme) levels of each terminal(S304); respectively calculating the current average data transfer rate according to the type of each service(S305); and selecting a service type and a terminal, which will receive the selected service, based on the MCS level and average data transfer rate(S306).
