A recording and/or reproducing apparatus and a method thereof are provided to check the position and the number of data processing layers included in a recording medium and to scan a light to the predetermined data processing layer by adjusting an aberration compensating unit with a signal reflected to the recording medium. A recording and/or reproducing apparatus comprises a lens unit and an aberration compensating unit. The lens unit is separated from a recording medium(50) by a predetermined distance. The aberration compensating unit is located on a route of lights adjustably. The aberration compensating unit changes the route of the lights so that the position of focus, where the light is scanned to the recording medium, changes. The aberration compensating unit includes a fixed first lens(31) and a movable second lens. The route of the light is changed by moving the second lens to an optical shaft direction.
