PROBLEM TO BE SOLVED: To provide an image color judging apparatus performing color judgment processing of an image having ground color, and to provide an image color judging method and its program. SOLUTION: The image color judging apparatus comprises a section for judging existence of the ground color of an object image based on the image data thereof, and judging the luminance and chrominance of the ground color when the object image has the ground color, and a section for judging the color of the object image based on the image data thereof wherein the object image judging section performs color judgment by utilizing the judgment results from the ground color judging section.
