PROBLEM TO BE SOLVED: To provide an intrusion detecting apparatus and an intrusion detecting method for detecting packets with illegitimately accessed data among received packets. SOLUTION: The intrusion detecting apparatus 10 with an analysis section 12d for analyzing packets received from a network 20 to discriminate illegitimately accessed packets, wherein the analysis processing executed by the analysis section 12d comprises a plurality of processes each with a processing number and stores a record including the received packets and a flag denoting whether or not illegitimate packets are stored in a storage device as packet storage data 16, includes: a storage processing section 12a that allows the storage device to store the packet storage data 16 associating the processing number of the packet analysis process having been executed until interruption by the analysis section 12d with the packets to the storage device when an interruption instruction is generated and the analysis processes executed by the analysis section 12d are interrupted; and an interruption processing instruction section 15 that generates an interruption instruction for interrupting the analysis process executed in the analysis section 12d.
