PROBLEM TO BE SOLVED: To provide an EGR failure determining device of an internal combustion engine capable of improving merchantability by accurately determining the failure of both an external EGR device and an internal EGR device regardless of the size of an EGR quantity. SOLUTION: This EGR failure determining device 1 has an ECU 2. The ECU 2 calculates the actual fresh air ratio (Step 21), and sets its target value KEGRCMD (Step 60), and calculates a feedback correction factor KEGRFB in response to the actual fresh air ratio KEGR and the target value KEGRCMD (Step 80), and controls an exhaust recirculating mechanism 16 and three variable mechanisms 50, 70 and 90 in response to the KEGRFB. The ECU 2 determines, when a relation of KSTEPEIPDLL < KEGRFB < KSTEPEIPDLH is not satisfied, that the three variable mechanisms 50, 70 and 90 are in failure in the case of EGRDIVIN >0.5, and that the exhaust recirculating mechanism 16 is in failure (Step 150, 153 to 157, and 161 to 163) in the case of EGRDIVIN≤0.5.
