PROBLEM TO BE SOLVED: To provide a device and a method for stream packeting which can packet stream data fast with small-sized, low-cost constitution. SOLUTION: A flag adding device 2a of an encoding device 2 adds a stream flag specifying a packet point to stream data and on the basis of the stream flag, a stream length counting device 3a of a stream length calculating device 3 and a header inserting device 5a of a header adding device 5 can specify the packet point, so the need to detect a special code that conventional technology uses is eliminated. Consequently, a device for detecting the special code is unneeded and the possibility of misdetection in the use of the special code is eliminated.
