PROBLEM TO BE SOLVED: To provide a surgical staple allowing a relative movement between legs after being disposed in a tissue. SOLUTION: A surgical staple comprises a first deformable leg member having at least a first portion of a staple backspan extending therefrom and a second deformable leg member having at least a second portion of the staple backspan extending therefrom.
