PROBLEM TO BE SOLVED: To obtain a new DNA fragment having promoter activity which is composed of DNA fragments derived from horseradish peroxidase isozyme gene having promoter activity in plant cells and is useful in a construction or the like of a high expression vector of a foreign protein gene in plant cells. SOLUTION: This DNA fragment is a new DNA fragment, which originates in horseradish peroxidase isozyme gene having promoter activity in plant cells and has four times or more promoter activity of cauliflower mosaic virus 35 S promoter, and is useful in the assembly or the like of the high expression vector of the foreign protein gene in plant cells since the DNA exerts fine promoter activity in plant cells or the like. This DNA fragment is obtained by extracting the DNA from cultured cells derived from stems of horseradish, preparing a DNA library by conventional method and screening this library with a labeling probe prepared from the cDNA of horseradish peroxidase.
