PROBLEM TO BE SOLVED: To provide a communication device capable of maintaining stable throughput in a multi-user MIMO (multi-input and multi-output) system, and to provide a transmission rate setting method. SOLUTION: The communication device 100 communicating using signals to which beam forming is performed, includes a transmission error rate estimating section for estimating the transmission error rate of the signals to which beam forming is performed, and a transmission control parameter selecting section for selecting a transmission control parameter so that the transmission error rate is a predetermined value or less.
