PROBLEM TO BE SOLVED: To solve the problem, wherein when a material with a refractive index of 3 or smaller is used, the material cannot be bent in the optical path, in a bending waveguide or cannot branch the optical path in a branching waveguide, and even if the material can bend or branch the optical path, it is hardly sufficient for practical use. SOLUTION: The optical element has a bending waveguide or a branching waveguide, wherein a structure formed of a material having different refractive index from that of an optical waveguide is disposed at a bending/branching portion in the optical waveguide. The structure disposed as above can realize a bending waveguide and a branching waveguide formed of a low-refractive-index material, with the electromagnetic field distribution disturbance at the bending/branching portion reduced.
