PURPOSE: A moving picture encoder, a moving picture encoding method, and a decoding method are provided to maintain the compression efficiency and provide the flexible service which fits to the transmitting environment. CONSTITUTION: A motion estimation mode determiner (141) determines a motion estimation mode based on the mutual relation between the motion vector (MV) predictors. An inter mode prediction unit (130) performs the motion prediction for each of the inter block mode, based on the motion estimation mode. An optimal mode determination unit (140) determines an optimal block mode based on the determined motion estimation mode, the result which is performed in the inter mode prediction unit, and an intra mode prediction unit (131).
