A method and an apparatus for transmitting a signal having differential quality according to a channel state are provided to provide differential quality of received contents to a number of receiving terminals belonging to a channel state having various bandwidth. A scalable coding part separates a multi media signal inputted from the outside into a base layer and an enhancement layer. A channel coding part enables the base layer and the enhancement layer to perform transmission error detection and scrambling respectively. A layer modulation part enables the base layer and the enhancement layer to perform modulation after performing symbol mapping for hierarchical modulation. A transmitter part transmits the modulated signals.
