PROBLEM TO BE SOLVED: To reduce the memory band per a predetermined area, in a video decoder and a video decoding method using a coding unit of a hierarchical structure.SOLUTION: A decoder performing video decoding by using inter prediction includes decoding control means for controlling the inter-PU partition type of a decoding object CU, based on whether or not the CU size of the decoding object CU (Coding Unit) is equal to a predetermined minimum inter-PU (Prediction Unit) size.
