A capacity control apparatus and a method thereof for enhancing the available capacity of a system are provided to manage the frequency resource by controlling the operation of the modem in a suitable algorithm efficiently. A recognition wireless function unit(200) determines a transceiving algorithm by selecting a frequency resource according to peripheral wireless channel environment. A software defined wireless modem unit sets up the operation of the modem according to transmitting and receiving algorithm. An antenna signal processing unit processes the output signal of the software define wireless modem unit according to the antenna. A broadband wireless signal processing unit converts the signal processed in the antenna signal processing unit into the radio signal.
