PROBLEM TO BE SOLVED: To provide a moving image encoder and a moving image encoding method for shortening delay time generated by the buffering of a decoder in the compression encoding of moving images. SOLUTION: The target bit number P of one picture which is the target value of the number of bits generated per picture is set and also an upper limit bit number uCg which is the upper limit value of the generation bit number of the picture is set. In the case a cumulative generation bit number Cg generated from the beginning to a macro block during encoding within the picture exceeds the upper limit bit number uCg in the middle of the picture during encoding, the encoding of the macro block is skipped and underflow is avoided. When the cumulative generation bit number Cg is smaller than the target bit number P of one picture even if encoding is performed to the last of the picture, stuffing is performed so as to turn the cumulative generation bit number Cg of one picture to the target bit number P of one picture.
