PROBLEM TO BE SOLVED: To provide an optical waveguide element which are hardly affected by deformation or stress due to a metallic plate or a heater and by temperature distribution at the time of heating by the heater. SOLUTION: In the optical waveguide element, a metallic plate or a heater is stuck to the body of the optical waveguide element (the body), with its stress and temperature controlled, wherein the body is formed with, on a substrate, one or more input waveguides, output waveguides, and phase contrast imparting waveguides to be connected to the input/output waveguides. Where d is the thickness of the body and s is an interval between the end face of the body and the phase contrast imparting waveguide closest to the end face, the body is formed in a manner that s≥d if the thickness d and a prescribed thickness d<SB>0</SB>are d≤d<SB>0</SB>and that s≥d<SB>0</SB>if d≥d<SB>0</SB>.
