2-Benzyl-7,7-dimethyl-6,8-dioxa-2-aza-spiro [3,5] nonane having the formula I

a process for the preparation of that compound, which comprises heating a dibromo dioxane derivative of formula II:

with benzylamine in an organic solvent and in the presence of an acid acceptor;
and the use of that compound as an intermediate in the preparation of 3-carboxy azetidine.
