The bypass valve (9) is arranged upstream of the turbine (4) of the turbocharger (3) and can be set to an open position in driven mode dependent on the charging pressure. A controller (11) produces a control signal defining the valve's opening cross-section. A state signal representing driven or engine braking mode is produced in an engine controller (2) and fed to the controller, which produces a first or second control signal corresp. to driven or braking mode respectively for engine state dependent setting of the valve. An Independent claim is also included for a method of setting a bypass valve in the exhaust system of an internal combustion engine.
