PROBLEM TO BE SOLVED: To provide a data detector and a data detection method that employ the PRML(Partial Response Maximum Likelihood) system based on a state transition diagram that takes effect of overwrite onto a reproduction waveform into account beforehand so as to compensate characteristic deterioration in a reproduction signal to reduce the equiligation error thereby realizing detection of data with high accuracy. SOLUTION: The data detector 20 adopting the PRML system generates a state transition diagram that takes also a distorted PR equalization waveform distorted by an O/W shift into account. That is, the detector detects reproduction data together with the presence of the O/W shift by adding even a value at a sample point of the shifted PR equalization waveform to an equalization reference level and also newly adding a corresponding transition state to the equalization reference level. Since the PR equalization error due to the O/W shift is decreased, the detector can detect data with high accuracy.
