PROBLEM TO BE SOLVED: To provide a highly reliable surface emission optical laser element having a low threshold current in which single transverse mode oscillation can be realized. SOLUTION: The surface emission optical laser element has such a structure as a lower reflective layer 2 is formed on a substrate 1. Upper region of the lower reflective layer 2 has mesa shape on which a lower clad layer 3, an active layer 4, an upper clad layer 5 and an upper reflective layer 6 are formed sequentially. The mesa shape is formed to have a circular horizontal cross-section. A contact layer 7 is formed on the upper reflective layer 6, an annular p-type electrode 8 having a central current injection region is arranged on the contact layer 7, and an n-side electrode 9 is arranged on the lower surface of the substrate 1. In a mirror layer of first period from the active layer side of the upper reflective layer 6, a current constriction layer 20 is formed of a current injection region 19a arranged in the vicinity of the center of mesa and having circular horizontal cross-section, and a selective oxidation layer 19b arranged contiguously to the current injection region 19a.
