PROBLEM TO BE SOLVED: To suppress increase in the time for processing.SOLUTION: The present invention includes: a coding control unit which controls whether to adopt a merge mode which during coding independently performed for each slice that divides a picture into a plurality of parts, merges an area to be processed with respect to motion information with a peripheral area located around the area, on the basis of information on the peripheral area belonging to the slice to which the area belongs to; a coding unit which codes the area by the merge mode or another mode in accordance with control by the coding control part.
