PROBLEM TO BE SOLVED: To perform encoding independently in a time direction for each tile.SOLUTION: When performing encoding while dividing a picture of a current image of an encoding object into tiles, in the case where a tile dividing method is fixed within a sequence including the current image, a motion compensation part generates a predictive image by performing motion compensation processing for each tile on a reference image within a co-located tile based on a motion vector that is detected within the tile. An operation part generates encoded data by encoding the current image using the predictive image. When the motion vector is detected within the tile, a setting part sets tile dividable information indicating that the reference image is limited within the co-located tile.
