The present invention relates to a promoter which maintains the continuous over-expression of an operatively linked foreign gene in the case of not only light condition but also dark condition under photoperiodism condition in which the light condition and the dark condition are repeated. Transgenic algae capable of the continuous over-expression of the foreign gene can be produced by using a composition of the present invention, and thus target protein can be mass-produced using the transgenic algae.
