<P>PROBLEM TO BE SOLVED: To provide a separator that can compose a battery with deterioration of battery characteristics suppressed and safety improved, and to provide the battery having the separator. <P>SOLUTION: The separator for the battery consists of a multi-layer porous membrane that at least has a resin porous membrane (I) and a heat-resistant porous layer (II) containing heat-resistant particulates as a main component. The separator for the battery in which a relationship of X-Y≤50 is satisfied if an air permeability of the multi-layer porous membrane is X (sec/100 ml) and that of the resin porous membrane (I) is Y (sec/100 ml), a positive electrode having an active material that can store and release Li ions, a negative electrode having the active material that can store and release Li ions, organic electrolytic solution, and a separator are equipped.
