Disclosed are a method for maximizing a data transmission rate of an uplink in a cognitive relay network and a device thereof. The device calculates the data transmission rate of each of direct paths not passing a relay station and indirect paths passing the relay station for one or more unlicensed user terminals, selects a transmission path for the unlicensed user terminals based on the data transmission rates, and sequentially eliminates the unlicensed user terminals in a lowest first order regarding the data transmission rates until the total number of resource blocks required to transmit data through the selected transmission path is equal to or lower than the number of available resource blocks in the cognitive relay network.
