Disclosed are a data transmitting apparatus and a data communication method using the same. The data transmitting apparatus according to an embodiment of the present invention comprises: a buffer management unit for generating a transmission buffer pool including a plurality of buffers each having a size corresponding to the size of a transmission packet, and managing buffer position information and buffer usage state information of each buffer; a data processing unit for dividing data into data blocks having predetermined sizes; and a data transmission unit for converting each data block inputted from the data processing unit into a plurality of transmission packets, and requesting buffer assignment corresponding to the number of transmission packets to the buffer management unit.
