Provided are an electric shock protection element and a portable electronic device including the same. According to an embodiment of the present invention, the electric shock protection element, arranged between a human body contactable conductor and an internal circuit portion of the electronic device, comprises: an element where a plurality of sheet layers are laminated; an electric shock protection portion including at least a pair of internal electrodes arranged inside the element to be spaced at certain intervals, and a gap formed between the internal electrodes; and at least one capacitor layer which passes a communication signal introduced from the conductor. The electric shock protection element satisfies the following formula in order to pass static electricity without insulation destruction when the static electricity is introduced from the conductor, to block a leakage current of an external power source introduced from a ground of the circuit portion, and to pass the communication signal introduced from the conductor: Vbr > Vin. Herein, Vbr is a breakdown voltage of the electric shock protection portion, and Vin is a rated voltage of the external power of the electric device.
