PROBLEM TO BE SOLVED: To achieve good decode processing depending on a decode capability at a reception side.SOLUTION: Image data of respective pictures that configure moving image data is hierarchically encoded to generate a first video stream that has encoding image data of a low hierarchy side picture and a second video stream that has encoding image data of a high hierarchy side picture. A level designation value of this first video stream is inserted into an NAL unit of an SPS of the first video stream. A multiplexed stream is transmitted. The multiplexed stream includes the first video stream and the second video stream, and includes a first descriptor into which the level designation value of this first video stream is inserted corresponding to the first video stream, and a second descriptor into which a level designation value of a video stream obtained by combining the first video stream and the second video stream is inserted corresponding to the second video stream.
