Provided are a wireless communication device, a wireless communication method and a computer program whereby the collisions between communication packets can be suppressed and hence the increase of power consumption caused by repetition of retransmission caused by such collisions can be suppressed, thereby elongating the battery life. A data sequence to be transmitted consists of a data main-body part and leading data the data amount of which is smaller than that of the data main-body part. A carrier sense is executed, and if it is determined that the frequency band of radio waves to be transmitted is not used by any other contending communication system, the leading data are transmitted after a lapse of a predetermined time. A carrier sense is executed after the completion of transmission of the leading data, and if it is determined that the frequency band is not used by any other contending communication system, the data main-body part is transmitted after a lapse of a predetermined time. If it is determined that the frequency band is used, the frequency band conflict is avoided.
