PROBLEM TO BE SOLVED: To improve image quality and coding efficiency in an upper-level hierarchy such as a basic layer, while securing independence of tile coding and decoding in hierarchical coding.SOLUTION: The coding and decoding is performed such that, in a basic layer and an expansion layer, the positions of independently decodable tiles are settable hierarchy-by-hierarchy in a manner to guarantee that all independently decodable tiles have relatively equal spatial positions.
