This image encoding method involves a configuration step (S404 and S406) in which, if a first bit rate type is selected to be fixed bit rate, then (1) a second bit rate type of a bitstream that contains encoded data of multiple images belonging to all temporal layers is configured as fixed bit rate, (2) a third bit rate of a sub-bitstream that is part of the bitstream and that contains encoded data of those images belonging to a temporal layer other than a topmost temporal layer is configured to variable bit rate.
