PROBLEM TO BE SOLVED: To provide a lighting device which enables improvement of the visibility during high beam light distribution pattern radiation even when having a low beam light distribution pattern formation part, and to provide a vehicle.SOLUTION: A lighting device 5 includes: a substrate 6 opening at the front surface side and having a low beam light distribution pattern formation part 14; a lens body 7 disposed at the front surface side of the substrate 6; a first light emitting element 10; and a second light emitting element 11. A refraction part 8 is provided at a lower portion of the lens body 7 and a non-refraction part 9 is provided at an upper portion of the lens body 7. The first light emitting element 10 is disposed at the rear side of the refraction part 8 of the lens body 7. The second light emitting element 11 is disposed at the front side of the first light emitting element 10 and the rear side of the non-refraction part 9 of the lens body 7. The low beam light distribution pattern formation part 14 is positioned at the front side of the first light emitting element 10.
