PROBLEM TO BE SOLVED: To provide a waste heat using device preventing a problem of a capacitor in surplus electricity storage of a capacitor, and allowing response to electricity storage without deteriorating working efficiency of a Rankine cycle when the electricity storage is required. SOLUTION: The waste heat using device comprises: the Rankine cycle 300 generating a driving force in an expander 320 by expansion of refrigerant heated by waste heat of a heat generating apparatus 10; an electric generator 321 connected with the expander 320 and driven by the driving force of the expander 320 to generate the electricity; and the capacitor 40 storing electric energy acquired from the electric generator 321. An avoiding means is provided to avoid the electricity storage in the capacitor 40 when surplus electricity storage is caused to the capacitor 40, while continuing the operation of the Rankine cycle 300, by the drive of the electric generator 321 along with operation of the Rankine cycle 300.
